Know Everything About UK Partner Visa
The family immigration program includes a UK Partner Visa or spouse visa that permits eligible foreign nationals to move in and live with their partners in the UK if they are British citizens or permanent residents.
Married partners of British or Irish citizens who wish to join or remain with their husband or wife in the UK may apply for a partner visa. This visa is also available to people with pre-settled status, and people with refugee status or humanitarian protection.
If your spouse is currently abroad but plans to join you in the UK, you can also apply for a UK Partner Visa. After five years, the UK Spouse Visa may result in settlement or indefinite leave to live in the UK.
What is aUK Partner Visa ?
In order to enter and reside in the UK, applicants must be either the spouse, civil partner, or unmarried partner of a UK citizen or a person who has already established permanent residence in the UK.
With a UK Partner Visa, a non-UK spouse or civil partner is able to visit the country as the partner of a British national who has established there or who has pre-settled status. It can be extended for up to 33 months and counts toward the requirement for obtaining permanent settled status. To qualify for a Spouse Visa for the UK, you must fulfill a number of requirements. These include fulfilling financial conditions and passing the "genuine connection test."
Contrast this with the UK Marriage visitor visa, which is given to people who want to visit the UK in order to get married or start a planned civil partnership with a UK citizen or regular UK resident.
UK Partner Visa Requirements & Eligibility
If you are single and want to get married in the UK, you might be able to do so by requesting a UK fiance visa.
You must meet the following conditions and eligibility requirements in order to be granted a UK Partner Visa or marriage visa:
The wedding's participants must be at least 18 years old.
The parties must have actually met, be wed legally, and have plans to cohabitate in the UK;
An application for a marriage visa must demonstrate that their sponsor can provide them with suitable housing in the UK without further reliance on public subsidies;
In order to qualify, your salary must be at least £18,600;
This cap is £22,400 for a single dependent kid and an additional £2,400 for each subsequent dependent child;
For entry clearance purposes, the applicant must complete a level A1 course in English, and for leave to remain in the UK, a level A2 course;
A marriage or spouse visa cannot be granted unless the relationship can be conclusively shown to be real or to be supported by strong evidence.
Financial Requirements and Exceptions
The amount of the financial criteria may be satisfied by UK sponsors (a person with Indefinite Leave to Remain or a British citizen) or applicants through employment, self-employment, cash savings, serving as a director of a company, rental income, etc. Depending on how you are meeting the financial criteria for UK Partner Visa, a different set of documentation must be provided with your application, which may include:
Income and savings sources, as necessary;
Timeframes and approved source combinations that may be used in conjunction with each authorized source used to support the application;
Documentary evidence was used as support for all allowed income sources.
There are, however, exceptions to meeting these thresholds during the UK Partner Visa applying. For instance, sponsors are exempt from the financial criteria if they receive any of the following privileges or allowances:
Compensation for extreme disability;
Benefit for industrial injury disability;
Attendance reimbursement;
Caretaker allowance
Disability living allowance, or personal independence payment;
Guaranteed Income Payment or Armed Forces Independence Payment under the Armed Forces Compensation Scheme;
The War Pensions Scheme's Constant Attendance Allowance, Mobility Supplement, or War Disablement Pension; or
Injury Pension for Police
However, if the applicant is receiving the advantages mentioned above, they must also meet the maintenance and housing requirements.
If your spouse or partner is unable to meet the financial requirements, there are other exceptions for UK Partner Visa. If "in-country" applicants do not fit the criteria for a grant of leave under the "EX.1" (Exception) paragraph of Appendix FM under the Immigration Rules, an exception may be issued for them. These exceptions typically apply when there is a child under the age of 18, when the applicant is British, has settled or has resided in the UK for seven years prior to the application date, or when moving outside the UK would present insurmountable challenges.
English Language Requirements
Applications for UK Partner Visa, like many other UK immigration applications, must meet certain English language standards.
By proving that you are a citizen of a nation with a majority of English-speaking people or that you have a degree that is at least as good as a UK bachelor's degree, you can satisfy the English language criteria for a UK spouse visa. In addition to this, you can pass an exam at the proper level.
You should utilize one of the recognized English language examinations on the Home Office's list to demonstrate your language proficiency. You must pass at CEFR A1 level for Entry Clearance if you're applying for a spouse or UK Partner Visa. For applicants submitting an application for a marriage or spouse visa extension after May 2017, the prerequisite changed to level A2.
How Long Can You Stay in the UK?
If you are applying from outside of the UK, your UK Partner Visa will be granted for 33 months; if you are applying from within the UK, it will be granted for 30 months. You would then need to submit an application for an extension of your marriage settlement visa. You would be qualified to apply for Indefinite Leave to Remain in the UK or British Citizenship after spending five years in the UK.
UK Partner Visa Processing Times
It might take anything from 30 days to 6 months to process a UK Partner Visa application, depending on the complexity. It might often take weeks only to gather your proof, finish your paperwork, and present your case.
